Terms of service

These Terms of Service (“Terms”) govern your use of services provided by Film Blvd Labs LLC (“Film Blvd.,” “we,” “us”), located at 7615 Biscayne Blvd, Suite 1, Miami, FL 33138. By placing an order, dropping off film, or using our website or customer account, you agree to these Terms.

1. Services

Film Blvd. provides photographic film development, high-resolution digital camera (“DSLR”) scanning, and a private customer account for storing, organizing, and downloading your scans. We accept 35mm and 120 format film in C-41, black & white, and E-6 chemistries. Service offerings, turnaround times, and prices are described on our website and may be updated from time to time.

2. Orders and payment

Payment is due in full at the time an order is placed, whether online, in person, or by mail-in. We accept payment through our payment processor, Stripe. All prices are listed in U.S. dollars and exclude any applicable taxes.

3. Film handling and liability

We treat every roll with the care we would want for our own work. Despite that care, film is a physical medium and processing carries inherent risk. By entrusting your film to us, you acknowledge and agree:

• Our maximum liability for any roll lost, damaged, or destroyed in our possession is limited to the replacement cost of one unexposed roll of comparable film stock, or the total amount you paid for services related to that roll, whichever is greater.
• We are not responsible for latent defects, improper exposure, camera malfunction, prior storage conditions, or X-ray damage that occurred before the film reached us.
• We are not responsible for delays caused by shipping carriers, force majeure events, or other circumstances outside our control.

4. Customer accounts

A Film Blvd. account is required to access your scans, place online orders, and unlock TIFF files. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

5. Intellectual property

You retain all copyright and other intellectual property rights in the photographs you submit. By using our services, you grant Film Blvd. a limited, non-exclusive license to process, scan, store, and deliver your images solely for the purpose of providing services to you. We will not use your images for marketing or any other purpose without your explicit written permission.

6. Storage and account access

Scans uploaded to your Film Blvd. account remain available for as long as your account is active and in good standing. We make commercially reasonable efforts to maintain backups, but you remain responsible for downloading and maintaining your own copies of any files that are important to you.

7. Refunds

Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.

8. Changes to these Terms

We may update these Terms from time to time. The version posted on this page is the current and effective version. Continued use of our services after a change to these Terms constitutes acceptance of the updated Terms.

9. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. The exclusive venue for any dispute arising out of or relating to these Terms or our services is the state and federal courts located in Miami-Dade County, Florida.
